La guida definitiva per i proprietari di immobili

Nel panorama del mercato immobiliare, è essenziale restare aggiornati sulle molte opzioni contrattuali e sulle leggi fiscali disponibili.

Un’opzione particolarmente attraente per i proprietari di immobili è il contratto di affitto con cedolare secca. Questa tipologia offre numerosi vantaggi, anche se può sembrare leggermente complicato se non sei familiare con la terminologia e le normative fiscali.

Cos’è la Cedolare Secca?

La cedolare secca è un regime fiscale introdotto in Italia nel 2011 con l’intento di semplificare le imposte sul reddito derivante dai contratti di locazione.

In pratica, si tratta di un’imposta sostitutiva dell’Irpef e delle relative addizionali sulle locazioni di immobili residenziali: se hai un contratto di affitto “a canone libero“, pagherai il 21% di tasse sul totale che riceverai annualmente dall’affitto dell’immobile. Invece, se hai un contratto “a canone concordato“, come in città densamente popolate, pagherai solo il 10% di tasse.

Facciamo un esempio per capire meglio. Poniamo un canone di affitto per un appartamento per 500 euro al mese: in un anno, riceverai in totale 6.000 euro. Se hai un contratto di affitto libero, dovrai pagare il 21% di tasse su 6.000 euro, che corrispondono a 1.260 euro. Quindi, dopo aver pagato le tasse, ti rimarranno 4.740 euro.

Se invece hai un contratto a canone concordato in una città molto popolata, dovrai pagare solo il 10% di tasse su questi 6.000 euro, che corrispondono a 600 euro. In questo caso, dopo aver pagato le tasse, ti rimarranno 5.400 euro.

Qual è il regime più conveniente tra IRPEF e cedolare secca?

Hai mai riflettuto su quanto potresti risparmiare se scegliessi la cedolare secca per il tuo immobile in affitto? Vediamo insieme alcuni esempi pratici che dimostrano come questa opzione possa essere più conveniente:

  • Se per esempio affitti il tuo immobile con un contratto libero, scegliendo la cedolare secca potresti guadagnare al netto 4.740 euro, contro i 4.620 euro che guadagneresti con l’Irpef.
  • Se invece decidi di fare un contratto a canone concordato, il vantaggio è ancora più grande: guadagneresti 5.400 euro con la cedolare secca, rispetto ai 4.620 euro che otterresti con l’Irpef.

Considera quindi che l’aliquota fiscale della cedolare secca è del 21% o addirittura del 10%, quindi sempre inferiore a quella Irpef, che parte dal 23% in su.

Quindi, in termini di tasse da pagare, la cedolare secca comporta una riduzione del carico fiscale. Ricorda che scegliere tra cedolare secca e Irpef non dipende solo da quanto puoi risparmiare in tasse, ci sono altri fattori da considerare, come la tua situazione fiscale personale.

In ogni caso,  considerando le aliquote attuali, possiamo dire che la cedolare secca permette di ridurre la pressione fiscale e di pagare meno tasse. Ricorda che ogni caso è unico, quindi prima di decidere, ti consigliamo di chiedere consiglio al nostro Team di esperti tramite il supporto clienti e proprietari.

Vantaggi e svantaggi della Cedolare Secca

Il principale vantaggio della cedolare secca risiede nella sua semplicità: non dovrai preoccuparti di calcolare le varie addizionali o detrazioni. Infatti, con la cedolare secca, pagherai una tassa fissa sul reddito derivante dall’affitto.

Tra gli svantaggi possiamo dire che, in caso di scelta della cedolare secca, il proprietario rinuncia, per tutta la durata dell’opzione, all’applicazione di qualsiasi tipo di aggiornamento del canone, compreso quello Istat. Questo significa che il canone richiesto rimarrebbe bloccato e uguale per tutti gli anni di contratto.

Quando è possibile scegliere la cedolare secca?

Se stai pensando di affittare la tua proprietà, potresti chiederti se optare per il regime di cedolare secca o se attenerti al regime ordinario Irpef. Non tutti possono scegliere, ci sono alcune condizioni da rispettare.

Prima di tutto, devi essere una persona fisica, essere proprietario dell’immobile o averne diritto di utilizzarla, come nel caso dell’usufrutto. 

In secondo luogo, l’immobile da locare deve essere registrato come unità abitativa ed affittato ad una o più persone per viverci, e non per altri scopi.

Non potrai usare la cedolare secca quindi se:

  • Affitti il tuo immobile per uso commerciale;
  • L’immobile è affittato ad una società;
  • Affitti la casa ad una persona la quale pone in subaffitto l’immobile o la usa per affitti turistici;
  • Il contratto di affitto prevede che l’inquilino utilizzi la casa anche come sede legale della sua società, anche se solo in minima parte.

Quindi, prima di fare la tua scelta, assicurati di rispettare queste condizioni. È importante capire tutte le regole per evitare problemi in futuro. Se non sei sicuro, rivolgiti al nostro Team di esperti.

La cedolare secca nei contratti con più proprietari

In questo paragrafo ti illustreremo alcune casistiche su chi può scegliere l’opzione della cedolare secca:

  • Se sei l’unico proprietario di un immobile, la scelta di applicare la cedolare secca o continuare con il regime Irpef dipenderà solo da te;
  • Nel caso, invece, in cui l’immobile ha due proprietari entrambi con il 50%, ogni proprietario dovrà decidere individualmente se scegliere la cedolare secca o mantenere l’Irpef;
  • Se possiedi più di un immobile, la scelta non si applica a tutti gli immobili che possiedi. Puoi scegliere quale regime fiscale preferisci per ogni contratto di locazione;
  • La situazione cambia quando si tratta di un unico immobile locato a più persone con contratti separati. Se opti per la cedolare secca per il primo contratto, dovrai applicare lo stesso regime a tutti gli altri contratti legati a quella stessa proprietà;
  • Rinuncia all’aggiornamento: se uno dei proprietari sceglie la cedolare secca, l’aggiornamento decade per entrambi, anche per il proprietario che ha scelto di rimanere con l’Irpef.

In caso di disaccordo tra i proprietari nella scelta dell’opzione di cedolare secca, si devono considerare due aspetti principali al momento della registrazione:

  • L’imposta di bollo: si deve pagare normalmente, ossia 16 euro per ogni 100 righe per ogni copia del contratto registrata.
  • L’imposta di registro: si calcola solo sulla quota di affitto che spetta al proprietario che sceglie di rimanere con l’Irpef. Per esempio, se due proprietari possiedono il 50% ciascuno dell’immobile ed uno sceglie la cedolare secca mentre l’altro no, si calcola l’imposta sul 50% dell’affitto annuo al tasso del 2%. Il minimo da pagare è comunque 67 euro. Di solito, le spese di registrazione (imposta di bollo e di registro) sono divise a metà tra proprietario e inquilino.

Come applicare la cedolare secca

Una volta che avrai deciso di utilizzare l’opzione della cedolare secca dovrai:

  • Informare l’inquilino;
  • Comunicare all’Agenzia delle Entrate la tua decisione. Questo vale anche se decidi di prolungare il contratto dopo che è già iniziato;
  • Pagare l’acconto e il saldo della cedolare secca nei tempi stabiliti;
  • Compilare la dichiarazione dei redditi: nonostante tu stia usando la cedolare secca, dovrai comunque dichiarare il reddito dell’affitto nella tua dichiarazione dei redditi.

Per contratti di affitto brevi, ovvero di una durata inferiore a 30 giorni all’anno, non è obbligatorio registrare il contratto. Tuttavia, se vorrai, potrai ancora scegliere di usare la cedolare secca.

Ricorda: anche se scegli di usare la cedolare secca, dovrai comunque dichiarare questa decisione nella tua dichiarazione dei redditi. Puoi farlo nel modulo 730 o nel modulo Unico PF.

Come pagare la cedolare secca

La cedolare secca si paga con un modulo chiamato F24. Ci sono alcune regole da seguire su come e quando pagare, a seconda dell’importo che devi versare:

  • Se l’imposta che devi pagare è minore o uguale a € 51,65, non devi preoccuparti di pagare un acconto. Inoltre, se è il tuo primo anno di affitto con cedolare secca o se non hai un anno di riferimento precedente, non devi pagare l’acconto.
  • Se l’importo che devi pagare è inferiore a € 257,52, devi pagare in unica soluzione entro il 30 novembre.
  • Se l’importo che devi pagare è superiore a € 257,52, lo pagherai in due rate: la prima rata, che rappresenta il 40% dell’importo totale, deve essere pagata entro il 16 giugno. Se paghi dopo tale data, puoi comunque farlo entro il 18 luglio, ma dovrai aggiungere lo 0,4% in più. La seconda rata, che rappresenta il 60% dell’importo totale, deve essere pagata entro il 30 novembre. Il saldo deve essere pagato entro il 30 giugno dell’anno successivo.

In conclusione, la cedolare secca può rappresentare un’opzione vantaggiosa per i proprietari di immobili che desiderano semplificare le loro imposte e ridurre il rischio di evasione fiscale.

La gestione del tuo immobile non deve essere complicata. Con le giuste informazioni, potrai fare scelte consapevoli che massimizzeranno i tuoi profitti e ridurranno il carico di lavoro.
